General Terms and Conditions

All registrations for events, talks, workshops and courses by post, fax, email or internet are binding.

Payment of the course fee (events, workshops)

After you've registered for a course, you'll receive a registration confirmation with the invoice from us. The payment deadline stated there is binding. Registration obliges you to pay the course fee. Non-payment of the course fee does not count as cancellation.

Course payments must be made at the latest on the first day of the course. Payments made later are charged with an additional reminder fee of 50 CHF. If the payment again does not reach us at the latest 10 days after the start of the course, a reminder fee of 100 CHF is charged.

Payment methods in the online shop

Orders in the online shop can be paid by TWINT, credit card (Mastercard, Visa) or PayPal; processing is handled by the Swiss payment provider Payrexx AG. From an order value of CHF 1000.–, purchase on invoice is also available. For online payments, the amount is due upon completion of the order.

Payment by instalments

For trainings from an order value of CHF 1000.–, we offer payment on invoice in 2 or 10 instalments. Instalment payment is subject to a surcharge; the total amount including the surcharge is shown at checkout and stated in the order confirmation. Instalments are due as invoiced. In the event of late payment, the remaining instalments may become due immediately.

Digital content (downloads)

Digital products (e.g. programs and scripts as PDF) are delivered after receipt of payment by e-mail with personal download links; the links are valid for 30 days. The content is intended for personal use and may not be shared, published or resold. Delivery is deemed completed when the download is made available; once the content has been accessed, there is no right of return for digital content.

Physical products and shipping

Physical products (e.g. training equipment) are shipped after receipt of payment to the delivery address provided. Any shipping costs are shown at checkout. Obvious transport damage or incorrect deliveries must be reported to us within 7 days of receipt.

Course organisation

For organisational reasons, we reserve the right to reschedule or combine courses, to change the venue or to shorten courses with a proportional refund of the course fee. If a course instructor is unavailable, the school management can carry out a change of course instructor or appoint a substitute. If a course has to be cancelled by the update Akademie, course costs already paid will be refunded; no further claims can be asserted.

Realisation

In order to be able to run our courses under optimal conditions, we set a minimum and a maximum number of participants for each learning offer. Course places are allocated in the order of registrations (subject to timely payment). In the case of an insufficient number of participants, the course is generally not held and the course fee is waived or refunded, or credited to another course.

In the case of an under-strength class, it may happen in individual cases that we hold the course subject to the consent of the course participants, but increase the course fee accordingly or, where sensible, reduce the number of lessons.

Exclusion from the course

The school management reserves the right to exclude one or more course participants from a course on justified grounds. In the following cases, the entire course fee is owed, i.e. there is neither a proportional refund nor a waiver of the course fee: exclusion from the course due to non-payment of the course fee as well as in serious cases (defamation, harassment, intentional damage to property, etc.).

Cancellations

Since all courses are started online, a cancellation is no longer possible after the course order.

Course rebookings

Course rebookings can take place a maximum of 1 time per course. The type of course can be changed in the process (example: course change from Pilates Instructor to Power Yoga Instructor).
The effort for the rebooking is charged at CHF 50.-.
The invoicing of the course remains in place and the payment deadline of the course invoice retains its validity.

Insurance

For all courses and events organised by the update Akademie, we exclude any liability for damages incurred. You are therefore responsible yourself for sufficient insurance coverage. Use of the update Akademie facilities is at your own risk. The update Akademie cannot be held liable for theft and loss of items.

Programme and price changes

Programme and price changes as well as changes to the General Terms and Conditions remain reserved.

Place of jurisdiction

For all legal relationships with the update Akademie, Swiss law is applicable. The place of jurisdiction is Münchwilen.
